Mississippi man to appear in federal court in ricin letters case

TUPELO, Mississippi (Reuters) - A Mississippi martial arts instructor is expected to appear in a federal court on Monday to face charges in connection with the mailing of letters containing the deadly poison ricin to President Barack Obama and other U.S. officials.

Everett Dutschke, 41, was arrested on Saturday in Tupelo, Miss., after authorities searched his former business and home. He was held in custody over the weekend and will make his first court appearance before a U.S. magistrate in Oxford on Monday.

His arrest came about two weeks after suspicious letters intended for Obama and U.S. Senator Roger Wicker of Mississippi were intercepted in Washington. Tests showed they were tainted with ricin, a highly lethal poison made from castor beans. Another such letter was sent to a Mississippi state judge.

Authorities initially arrested another Mississippi man, Kevin Curtis, in the case but dropped the charges last week after a search of his house failed to turn up any evidence of his involvement.

Dutschke's name surfaced at a court hearing when Curtis' attorney suggested someone had framed her client and mentioned a running feud between the two men.

Authorities said Dutschke was charged with "developing, producing, stockpiling, transferring, acquiring, retaining and possessing a biological agent, toxin and delivery system, for use as a weapon, to wit: ricin."

He faces a possible life sentence if convicted.

Dutschke's attorney, Lori Basham, did not return calls seeking comment. She said last week that Dutschke had denied having anything to do with the ricin letters and had said he was cooperating with federal officials during their searches.

The ricin-tainted letters were discovered just days after the bombings of the Boston Marathon and during the massive police manhunt for those responsible, helping to fuel anxiety in the United States, especially in the capital.

The case rekindled memories of the 2001 U.S. anthrax attacks that killed five people and puzzled investigators for years. The Justice Department later said that a U.S. scientist who committed suicide was responsible.

'Red line' _ US says Syria used chemical weapons

WASHINGTON (AP) ? U.S. intelligence has concluded "with some degree of varying confidence" that the Syrian government has twice used chemical weapons in its fierce civil war, the White House and other top administration officials said Thursday.

However, officials also said more definitive proof was needed and the U.S. was not ready to escalate its involvement in Syria. That response appeared to be an effort to bide time, given President Barack Obama's repeated public assertions that Syria's use of chemical weapons, or the transfer of its stockpiles to a terrorist group, would cross a "red line."

The White House disclosed the new intelligence Thursday in letters to two senators, and Defense Secretary Chuck Hagel, traveling in Abu Dhabi, also discussed it with reporters.

"Our intelligence community does assess, with varying degrees of confidence, that the Syrian regime has used chemical weapons on a small scale in Syria, specifically, the chemical agent sarin," the White House said in its letter, which was signed by Obama's legislative director, Miguel Rodriguez.

Shortly after the letters was made public, Secretary of State John Kerry said on Capitol Hill that there were two instances of chemical weapons use.

Hagel said the use of chemical weapons "violates every convention of warfare."

It was not immediately clear what quantity of weapons might have been used, or when or what casualties might have resulted.

Obama has said the use of chemical weapons would be a "game-changer" in the U.S. position on intervening in the Syrian civil war, and the letter to Congress reiterated that the use or transfer of such weapons in Syria was a "red line for the United States." However, the letter also suggested a broad U.S. response was not imminent.

Rodriguez wrote that "because the president takes this issue so seriously, we have an obligation to fully investigate any and all evidence of chemical weapons use within Syria."

The letter went to Sens. John McCain, R-Ariz., and Carl Levin, D-Mich.

The assessment, Rodriguez said, was based in part on "physiological samples."

The letter also said the U.S. believes the use of chemical weapons "originated with the Assad regime." That is consistent with the Obama administration's assertion that the Syrian rebels do not have access to the country's stockpiles.

A senior defense official cautioned that the White House letter was not an "automatic trigger" for policy decisions on the use of military force. The official alluded to past instances of policy decisions that were based on what turned out to be flawed intelligence, such as the Bush administration's decision to invade Iraq after concluding that Saddam Hussein had weapons of mass destruction, including nuclear weapons.

The official commented only on condition of anonymity because he was not authorized to speak publicly.

McCain quoted from the letter in making his own comments to reporters on Capitol Hill.

"We just received a letter from the president in response to our question about whether Assad had used chemical weapons," McCain said following a closed briefing with Kerry on Syria and North Korea.

Dozens feared dead in Russian psychiatric hospital fire

RAMENSKY, Russia (Reuters) - At least 36 people were feared dead after a fire raged through a psychiatric hospital north of Moscow on Friday, killing some patients in their beds and others who were trapped by barred windows.

The fire broke out in the early hours and swept through a single-storey building at the hospital in woods in the village of Ramensky, officials said.

Twelve bodies had been found by mid-morning, the Emergencies Ministry said, as grey smoke billowed from the charred yellow-brick building.

Andrei Vorobyov, interim governor of the Moscow region, said a nurse had led two patients to safety. He said 36 others were believed to have been in the hospital when the fire broke out, but another local official said 38 were feared dead.

"Those who were in there said it happened in a flash. The nurse opened the door to the room and there was smoke, and even when she saw the fire she could not get to the fire extinguisher. It all happened very quickly," he told Russia 24 television.

He said some windows had been barred to meet regulations while others had not, so the investigators would be able to determine whether they had prevented people from escaping.

"Obviously, all the patients were sleeping and they were sick people ... so they would have needed help to get out," he said, adding that the nearest fire station was a 40-minute drive away.

President Vladimir Putin called for an explanation of the "tragedy" and told emergency services to do all they could to help.

Fires at state institutions in Russia such as hospitals, schools, drug treatment centers and homes for the elderly or disabled often cause casualties, raising questions about safety measures, conditions and escape routes.

Dmitry Pestov, deputy head of the Moscow region, said 41 people had been in the building but three had been saved and were in hospital.

"Fire safety watchdogs constantly check all (public) institutions and issue recommendations. As far as I know, all the recommendations had been followed," he told reporters outside the hospital which still smoldered.

"There are different versions, including arson and a short circuit. They will be checked."

Some people stood on the opposite bank of the Moscow canal from the hospital, trying to get across to check whether their relatives had survived. The police had stopped the ferry and fishing boats were not allowed to cross.

"They are not letting the relatives in. Why? How can we get there?" said Konstantin, whose father was in the hospital, which is about 120 km (70 miles) north of Moscow.

"Living conditions? It was a slum in there. No conditions."

More than 12,000 people were killed in fires in 2011 and more than 7,700 in the first nine months of 2012 in Russia, where the per capita death rate from fires is much higher than in Western nations including the United States.

Shelton calls 'Voice' panel 'as strong as ever'

When NBC announced at the end of last season that popular judges Christina Aguilera and Ceelo Green were temporarily leaving "The Voice" in order to pursue their own musical endeavors, viewers were skeptical the show would be as good with Shakira and Usher sitting in their places.

On Monday, at a panel discussion for "The Voice" held during NBC Summer Press Day, mainstay judges Adam Levine and Blake Shelton revealed that they, too, were worried the new judging panel wouldn't be as good as the original.

"I was a little nervous. [The show] was beating the odds," said Shelton. "It was a [successful] music talent show in a world where there's a lot of those. I never met [Usher or Shakira] before, and one thing you can't fake is chemistry. And damned if its not as strong as its ever been."

"We were certainly curious to see what the chemistry would be when the new guy and gal came," Levine told reporters after the panel discussion. "I think that we're beyond happy ... It's obvious, too, if you watch the show that there's a lot of chemistry."

Levine and Shelton weren't the only ones that didn't know what to expect in regards to the new format.

"I didn't get any preparation for this show," Shakira told the audience. "I was thrown to the lions with no rehearsal time. There really was no guidance whatsoever. [The producers told me] 'just be yourself.' There are no poses here. It's just all about being spontaneous."

Usher, too, remarked that he was worried about being able to find his place on a show that was already a big hit.

"They didn't need us in order for the show to work," he said. "I was very proud of what I saw before [and] I brought years of experience and opinion ... being able to mentor other artists."

Shelton had nothing but praise for his new co-stars, and the production team that chose them to replace Green and Aguilera after last season.

"[Whoever] picked these two knew they weren't dealing with artists with egos," Shelton said. "They [are] really good people."

From Usher's signature "one leg up" judging stance ("The network was originally against it," Usher told the audience. "[They said] we don't think that will read well. But it worked!") to the foursome's playful ribbing of one another, the new formula is certainly working, something executive producer Mark Burnett also attributed to the show's focus on keeping things fresh.

"'The Voice' has clearly been claimed by young America. It's fresh, the music is current. [These judges] are current super stars," he said, slightly jabbing at other singing shows that use judges whose careers may be past their prime. "This is not their day job -- their day job is touring and making music."

With all the talk about how great the new judging panel has been working out for the show, audience members were eager to find out if Green and Aguilera would even be invited to return next season, but even NBC doesn't seem sure on what to do. A rep announced during the panel discussion that no decision had been made yet in regards to who would be sitting in the judges' chairs for season five.

FOREST TRENDS (FT) is an international not-for-profit forest conservation organization based in Washington, D.C., that works to achieve sustainable forest management and conservation by capturing market values for ecosystem services; supporting innovative projects and companies that are developing these new markets; and enhancing the livelihoods of local communities living in and around those forests. The??Public Private Co-Finance Initiative at FT works with partners in the public and private sector to develop innovative financing structures and architecture so the greatest amount of capital possible flows to activities that reduce emissions from deforestation and degradation (REDD+), improve the productivity of agricultural and livestock systems, and improve livelihoods of rural populations. In Brazil, the PPF Initiative is working in states such as Acre and Mato Grosso to understand the current sources of financing available and the financing gaps to transition traditional agricultural/livestock systems in sectors such as soy and beef to no/low deforestation models. We are analyzing agricultural programs and sources of finance at the Federal Level that may support this transition. Working with the public and private sectors, we will work to build integrated and efficient financial architecture at the jurisdiction level that supports investment into these new models. In addition, we are working in Acre to help structure the state?s Public Private Company for Environmental Services so it is best able to support the state in achieving its low-emission development goals and emissions reductions.

Consultancy: Scope of Work.??We are seeking a consultant to work closely with other senior staff and specialists at Forest Trends and its network of partners to:

???????Use third party technical and economic analysis to complete and/or provide input into financial models to understand the financing gaps for REDD+ activities in Brazil, including transformation of agriculture and livestock production models into low/no deforestation models, as well as other changes in land use practices such as restoration of degraded lands, afforestation, etc. This may include due diligence on the financial models themselves.

???????Review and identify public sector incentives and potential sources of public finance or rural credit (e.g. ABC, Pronaf) that could be integrated into REDD+ and private sector financing;

Ailing Glen Campbell done touring but will release new album

LOS ANGELES (Reuters) - Country singer Glen Campbell is set to release what could be his final album as the "Rhinestone Cowboy" singer's health has deteriorated after being diagnosed with Alzheimer's disease two years ago.

"See You There," which will be released on July 30, features Campbell singing new versions of old songs, including hits "Galveston, "True Grit" and "Gentle on My Mind," record company Surfdog said on Monday.

Campbell, who turned 77 on Monday, performed at the Grammy Awards ceremony in 2012 and completed a farewell "Goodbye Tour" in November.

"See You There" consists of new vocals for several of his past hits that he laid down while recording his "Ghost on the Canvas" album, which was released in 2011.

"He's done touring," longtime publicist Sandy Brokaw told Reuters. "He went on the good-bye tour and wanted to see how it was with his health. After Christmas they put a big bow on it and wrapped it (Campbell's touring) up."

Brokaw said Campbell's health had deteriorated in recent months.

"He can't do an interview; he's confused," Brokaw said. "He's not comfortable on live TV anymore."

Campbell announced in 2011 ahead of his final tour that he had been diagnosed with Alzheimer's disease after suffering from short-term memory loss for years.

Campbell, who started out as a session guitarist for the Beach Boys and producer Phil Spector, rose to prominence in the 1960s with such hits as "Wichita Lineman" and "By the Time I Get to Phoenix."

He is best known for "Rhinestone Cowboy," a No. 1 hit in 1975, and was inducted into the Rock and Roll Hall of Fame in 2005.

NBC sportscaster Al Michaels arrested on DUI

(Reuters) - Television sports announcer Al Michaels was arrested over the weekend in Santa Monica, California, and charged with a misdemeanor offense of driving while under the influence, police officials said on Sunday.

The 68-year-old sportscaster was pulled over on Michigan Avenue in Santa Monica after two officers saw him make an illegal U-turn, Santa Monica Police Sergeant Rich Lewis told Reuters.

The officers administered a sobriety test after they observed that Michaels smelled of alcohol and had slurred speech, Lewis said. Michaels was arrested for driving under the influence with a blood alcohol content of 0.08 or greater, he said.

Sergeant Lewis declined to say what Michaels' blood alcohol content registered at, but he did say Michaels was "cooperative."

Michaels, a veteran play-by-play announcer for NBC's "Sunday Night Football," was arrested at 9:59 p.m. local time on Friday, according to the Los Angeles Inmate Information Center website.

He was released on Saturday and was scheduled to appear at the Los Angeles Municipal Court on June 26, according to the site.

Michaels was not immediately available for comment.

An NBC spokesman said, "we are aware of the situation and we've spoken to Al. We have no further comment at this time."

Caterpillar 1Q profit shrank; cuts 2013 outlook

(AP) ? A slowdown in the mining business is digging a hole in Caterpillar's profits.

First-quarter profit shrank 45 percent. Caterpillar lowered its expectations for full year sales and profits because its mining business is slowing. Sales of Caterpillar-branded mining machines will drop by half this year, the company said on Monday.

Caterpillar said mining customers placed big orders for gear last year, just as mining profits fell, so now those customers are cutting back. Dealers who would normally be stocking up on Caterpillar gear to get ready for a busy summer instead cut inventory during the first quarter.

Caterpillar has already started cutting costs. On April 5 it said it would lay off more than 460 employees at a mining truck plant in Decatur, Ill. Caterpillar also announced mining-related layoffs in Milwaukee and plans to cut 1,300 of 3,400 jobs at a plant near Brussels that makes excavators, loading vehicles, and engine parts. This year's capital spending ? which covers big-ticket items like factories and computer systems ? will fall below $3 billion, down from $3.4 billion last year.

Net income dropped to $882 million, or $1.31 per share. Revenue fell 17 percent to $13.21 billion, from $15.98 billion a year ago. Both missed analyst expectations. Analysts surveyed by FactSet were expecting a profit of $1.36 per share on revenue of $13.79 billion.

It also cut its 2013 guidance. Caterpillar now expects to earn $7 per share, down from $7 to $9 previously. It forecast revenue of $57 billion to $61 billion, down from $60 billion to $68 billion. Analysts were expecting a 2013 profit of $7.67 per share on revenue of $62.48 billion.

There were some bright spots. Sales in China rose compared to a year ago. And the company is "becoming more optimistic" on the U.S. housing sector.

Shares of Peoria, Ill.-based Caterpillar Inc. rose 70 cents to $81.13 in premarket trading.

The debate over CISPA, a law that could change Internet privacy

Overshadowed by congressional action on guns and immigration is an Internet privacy bill that could affect most Americans, without them knowing it, on a daily basis.

Cyber Intelligence Sharing and Protection Act (or CISPA) is making its way through Congress, and it?s passed a House vote on Thursday.

The final vote in the House was 248-168, as 42 Democrats voted for the bill, while 28 Republicans voted against it.

And like gun control, it?s far from a done deal after the House passes CISPA. It would need Senate approval, and President Barack Obama has indicated he?ll possibly veto CISPA if it comes to his desk.

Both sides of Congress would need to muster a two-thirds majority vote to override the president?s veto, which would seem unlikely in the current political atmosphere of Washington.

At the heart of CISPA is a Fourth Amendment issue.

The amendment reads:

?The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.?

CISPA is designed to let the federal government work with private companies to fight hackers and cybercriminals in and outside of the United States. As part of the effort to detect cyber threats, private companies could voluntarily share with the government data about Internet users.

The sharing could be done in ?real time? as the cybercops try to defeat and track down the evildoers. Companies could also share data among themselves as part of the effort.

There are major drawbacks about the legislation, say CISPA?s critics. The privacy provisions for consumers, they claim, are vague or nonexistent. The government and companies can?t look at your personal data, such as medical records and tax returns, if they are part of the ?data dump? that is shared in real time. But the law doesn?t require that companies excise, or edit out, that information in the transfer process.

Another criticism is that a warrant isn?t needed for the government to obtain that information. And companies that share your information won?t be held legally liable for sharing that information, a practice that seemingly conflicts with privacy policies on existing websites.

CISPA?s biggest critic in Congress is a representative from Colorado, Jared Polis. The Democrat told the House on Wednesday, ?This is the biggest government takeover of personal information that I?ve seen during my time here in Congress.?

Mike Rogers, a Republican representative from Michigan and the House Intelligence Committee chairman, is leading the CISPA effort, along with Dutch Ruppersberger, a Democrat from Maryland.

Rogers believes the measure is long needed. ?People were stealing their identities, their accounts, their intellectual property, and subsequent to that, their jobs,? he recently said. ?[Web users] began to question the value of getting on Internet and using [it] for commercial purposes. Their trust in the free and open Internet ? was at risk.?

He has also stressed that participation in CISPA is voluntary for companies.

The Intelligence Committee also released a five-page document to counter what it calls ?myths? about CISPA, including how much personal data would be shared with the government?which it says would be a rare occurrence.

The American Civil Liberties Union, however, calls CISPA ?fatally flawed.?

?The core problem is that CISPA allows too much sensitive information to be shared with too many people in the first place, including the National Security Agency,? it says.

Unlike SOPA, the failed legislative attempt last year to halt online piracy, large tech companies are supporting the efforts to get CISPA passed.

At one time, Facebook and Microsoft had signed on to support CISPA, but now they are reportedly backing away. Google appears to be on the fence about the issue.

Major communications and utilities companies support CISPA, according to a list released by the House.

Last year, the House passed a similar CISPA bill, only to see it die in the Senate. Last August, a successful filibuster blocked CISPA from getting to the floor for a vote. Both libertarians and liberals had issues with the bill, and there were disagreements about which government agencies would be involved with CISPA.

The tea party-aligned group FreedomWorks is on record, again, as opposing CISPA on Fourth Amendment grounds.

?There are grave Fourth Amendment concerns with CISPA. The bill would override existing privacy laws to allow companies to share ?cyber threat information? with the federal government without making any reasonable effort to strip out any personal information from the file,? the group said in a statement.

The Electronic Frontier Foundation also has Fourth Amendment concerns.

?As it stands, CISPA is dangerously vague, and should not?allow for any expansion of?government powers through a series of poorly worded?definitions.??If the drafters intend to?give new powers to the government?s already extensive capacity to examine your?private?information, they should propose clear and specific language so we can?have a real debate,? the EFF said on its website.

Apparently the cheerleaders had visited last December while he was sick. The Houston Texans said that they got a call from Bush's people, saying he wanted to come to tryouts. Cheerleader Director Alto Gary said, "Like I could say no!" She added, "When he came in, he had the biggest smile on his face."

The cheerleaders complimented him on his socks; Bush replied, "I'm surprised you noticed them."

Bowles and Simpson offer a modified budget plan

WASHINGTON (AP) ? The chairmen of President Barack Obama's 2010 fiscal commission are wading back into Washington's budget wars with a revised, somewhat milder plan to rein in intractable federal deficits.

The plan by former Clinton White House chief of staff Erskine Bowles and former Republican Sen. Alan Simpson of Wyoming would lop more than $5 trillion from deficits over the upcoming decade when combined with the deficit-cutting steps enacted in fits and starts since his 2010 proposal.

It's unclear what impact the updated plan will have on the bitter divide over taxes, spending and debt. The initial Bowles-Simpson plan won warm reviews from deficit hawks but received a chilly reception from Obama and much of the rest of official Washington for its tough mix of tax increases and cuts to benefits programs.
